RA Forms

Representation Agreement Forms – BC

Nidus provides free Representation Agreement forms for personal use.  The place to start is with capability requirements – different forms have different definitions of capability. Links to forms below.

A Representation Agreement is a legal document.

LEGAL REQUIREMENTS TO MAKE AN AGREEMENT:

  1. Age – must be 19 years. The age of adulthood in BC is 19 years or older. (In Ontario and some other provinces it is 18.) Parental rights end when a child turns 19.
  2. Mental Capability – Two definitions in BC:
  • Traditional definition – must cognitively understand the nature and effect of the document at the time of making it. (This definition applies to making a contract, making types of power of attorney, making a Will, making an RA9, getting married.)
  • New RA7 definition – may make Representation Agreement with standard powers under section 7 (RA7) – even if capability to ‘understand’ is in question. (An RA7 can cover minor and major health care, personal care matters, routine financial and legal affairs.)

A Representation Agreement is a LEGAL DOCUMENT.

 

The forms provided by Nidus meet the requirements of the law and practical needs. Follow the INSTRUCTIONS provided with the form to make a valid document.

1) For adults with a disability from birth or childhood 

— and whose capability to ‘understand’ is in question (RA7 definition)

 

An RA7 may be made by adults with FASD, with autism, other disabilities – sometimes referred to as ‘special needs.’ These adults often make RA7 when turning 19 (sometimes called transitioning) or at older age.

2) For adults who meet traditional definition of capability – understand nature and effect

— make now while competent to understand in case become incompetent in the future due to injury or illness

NOTE: The RA9 does NOT include financial authorities. To learn about documents to cover financial and legal authorities, click on heading above beside 2), scroll down the web page for the information about “Planning for Financial and Legal affairs” (near bottom of page).

 
 

3) For adults whose mental capability was affected in adulthood (not at birth or childhood)

— “my spouse/parent/friend has advanced dementia or just had a serious stroke…” 

and their capability to understand is in question (new RA7 definition of capability)

 

These adults were mentally capable to understand at one time but did not make arrangements for documents based on the traditional definition of capability, like at #2 above. Now their capability is based on the new RA7 definition. They need help in some or all life areas.

Did the adult make an Enduring Power of Attorney when capable to understand and it is still feasible?

Need personal help?

Our ability to provide personal help depends on funding. We currently have some funding from CLBC to help folks in the community living sector with the RA7. Trained resource people can help by phone.

Email us at info@nidus.ca – give us some background on the need and we’ll try to match you up with the appropriate resource people for help by phone. Even if you aren’t in the target groups, email us if you need help and we’ll try to respond by email. If you don’t use email, ask someone to email for you.
